I. STATEMENT OF FACT [Type Statement of Fact for NOTICE OF REFUSAL OF INTERVIEW OF CRIME VICTIM BY DEFENDANT here.] II. LAW AND ARGUMENT Ariz. Const. Art. II; §2.1 (5) provides: [A] The victim of a crime has a right to refuse an interview deposition or other discovery request by the defendant, the defendant’s attorney or other person acting on behalf of the defendant. A trial court order requiring the victim of a crime to be interviewed is not valid. State v. Warner, 168 Ariz. 266, 812 P.2d 1079 (App., 1990). Victims of crime can refuse an interview requested by defense counsel pursuant to Victims’ Bill or Rights. State v. Towery, 186 Ariz. 168, 920 P.2d. cert. Den., 117 S. Ct. 985 Counsel for the victim gives notice to this court, the State and the defense that the victim, (VICTIM’S NAME) hereby invokes (his/her) constitutional right to refuse to participate in a defense interview.
