I. STATEMENT OF FACT [Type Statement of Fact for MOTION FOR SPEEDY TRIAL/ACCELERATION OF TRIAL DATE here.] II. LAW AND ARGUMENT The victim of crime has a right to a speedy trial or disposition. Ariz. Const. Art. II; §2.1 (10). The right of a victim to a speedy trial is balanced with the defendant’s due process right to a fundamentally fair trial. State, ex rel. Romley v. Superior Court, Roper, RPI, 172 Ariz. 232, 836 P.2d 445 (App. 1992). The Victims’ Bill of Rights must be proportionate to the interest of protecting the victim as balanced against the defendant’s due process right to a fundamentally fair trial. Id. The trial date should be set at a date which satisfies both the victim’s right to a speedy trial and the defendant’s right to a fair trial.
